3. HIPAA & Med-Legal Evaluations
- If you are a treatment patient, your health information is protected under the Health Insurance Portability and Accountability Act (HIPAA). You have rights under HIPAA, including access to your records, requesting corrections, restricting disclosures, and filing complaints.
- If you are seen for a Qualified Medical Evaluation (QME), Independent Medical Evaluation (IME), Agreed Medical Evaluation (AME), Subsequent Injuries Benefits Trust Fund (SIBTF) or Expert Witness examination, you are not considered a treatment patient of Dr. Rolfe. These evaluations are for legal and administrative purposes only, and HIPAA privacy protections do not apply. Instead:
- Reports and findings are shared with the requesting party (e.g., insurance company, attorney, or the State of California Workers’ Compensation system).
- Confidentiality is still maintained in accordance with California state law and professional ethical obligations.
- No ongoing treatment or doctor–patient relationship is established through these evaluations.
4. How We Protect Your Information
- Patient data is stored and transmitted using HIPAA-compliant systems.
- Med-legal data is handled with professional discretion, in line with legal and regulatory requirements.
- Website contact forms are not intended for urgent or sensitive health information—please call directly for care.
